No 3029 – Recognition of professional qualification for the profession of “internal auditor in the public sector” obtained abroad

A certificate shall be issued for recognition of professional qualification for the profession of “internal auditor in the public sector” obtained abroad by persons wishing to exercise this profession in the Republic of Bulgaria.

Working hours: Flexible working hours, from 07.30 until 18.30. In terms of the application of the flexible working hours, internal conditions have been established to ensure the presence of a sufficient number of officials in the period from 09.00 until 17.30. The working hours of the specialised desk of the administrative services unit (Reception Room for Citizens) are from 9.00 until 17.30.

The Minister of Finance shall recognise the professional qualification for the profession of “internal auditor in the public sector” in accordance with the provisions of the Recognition of Professional Qualifications Act.

The procedure for recognition of the professional qualification shall be organised and conducted by a commission in accordance with Article 79 of the Recognition of Professional Qualifications Act.

Applicant

Citizens of EU Member States, EEA countries and Switzerland as well as third country citizens with professional qualification for the profession of “internal auditor in the public sector” obtained in an EU Member State, EEA countries and Switzerland, and citizens of Bulgaria with professional qualification for the profession of “internal auditor in the public sector” obtained in an EU Member State, EEA countries and Switzerland or a non-EU country, who wish to exercise it in the Republic of Bulgaria.

Documents required

Pursuant to Article 77 of the Recognition of Professional Qualifications Act the person shall submit an application in a standard form at the Ministry of Finance. In accordance with Article 77(2) of the Recognition of Professional Qualifications Act  and Annex No 25 to Council of Ministers’ Decision No 619 (promulgated, SG, issue No 61 of 31 July 2009; amended and supplemented, SG, issue No 30 of 17.04.2012), the following documents shall be attached to the application:

  1. A copy of the diploma, certificate or another proof of the professional qualification for the profession of “internal auditor in the public sector” and the relevant attachments thereto.

The copies of the diploma, certificate or another proof of the professional qualification for the profession of “internal auditor in the public sector” and the relevant attachments thereto should be certified either with an Apostille or by the diplomatic mission or consular post of the respective country to the Republic of Bulgaria, or by the Ministry of Foreign Affairs of the country having issued the document. The copies of the above documents shall be submitted together with their translation into Bulgarian language. The translation of the document into Bulgarian language should also be duly certified in one of the following ways: If the foreign document is translated into Bulgarian language on the territory of the Republic of Bulgaria, then the signature of the translator affixed to the translation made by him/her should be certified by a notary in the Republic of Bulgaria. If the foreign document is translated in another country, then the signature of the translator should be certified by the diplomatic mission or consular post of the Republic of Bulgaria in the relevant country.

  1. Document for identity of names (for persons with different names).

The document for identity of names shall be submitted in original.

When the document is not issued in the Republic of Bulgaria it should be certified either with an Apostille or by the diplomatic mission or consular post of the respective country to the Republic of Bulgaria, or by the Ministry of Foreign Affairs of the country having issued the document. The document shall be submitted together with its translation into Bulgarian language. The translation of the document into Bulgarian language should also be duly certified in one of the following ways: If the foreign document is translated into Bulgarian language on the territory of the Republic of Bulgaria, then the signature of the translator affixed to the translation made by him/her should be certified by a notary in the Republic of Bulgaria. If the foreign document is translated in another country, then the signature of the translator should be certified by the diplomatic mission or consular post of the Republic of Bulgaria in the relevant country.

A fee to the amount of BGN 260 shall be paid for the service, as per the Rate schedule for the fees collected under the Recognition of Professional Qualifications Act, as adopted by Decree No 178 of 10 July 2009 (promulgated SG No 57 from 24.07.2009; amended, SG No 16 from 22.02.2011, effective as from 22.02.2011).

The fee for the service may be paid in one of the following ways:

  1. Procedure, including deadlines for appealing the activities of the authority providing the service

The decision and refusal to recognise access to the profession of “internal auditor in the public sector” or its exercising on the territory of the Republic of Bulgaria shall be contestable to the Supreme Administrative Court within 14 days after the communication thereof, under the terms and conditions of the Code of Administrative Procedure.

A tacit refusal shall be contestable within one month after the expiry of 3 months from the date of submission of the application and all necessary documents.

The appeal shall be lodged in writing through the Minister of Finance and should state:

  1. specification of the court;
  2. the full name and address, telephone number, fax number and e-mail address, if available – applicable to Bulgarian citizens;
  3. the full name and address, the personal number – applicable to foreigners;
  4. indication of the administrative act which is contested;
  5. specification of the legal non-conformity of the act;
  6. essence of the request;
  7. signature of the person who lodges the appeal.

In the appeal, the contestant shall be obligated to specify the evidence which the contestant wants to be collected and to present the written evidence in the possession thereof.

The following shall be attached to the appeal:

  1. power of attorney, where the appeal is lodged by an authorized representative;
  2. documentary proof of state charge paid, where such is due;
  3. transcripts of the appeal, of the written evidence and of the attachments according to the number of the rest of the parties.

  1. Ways of receiving the result:

Following the placement of a reference number, the certificate for recognition of professional qualification for the profession of “internal auditor in the public sector” shall be received by the applicant or by an authorised person at the Ministry of Finance.

The persons with recognised professional qualification for the profession of “internal auditor in the public sector” shall be entered in a list kept and updated by the Ministry of Finance.
