DIRECTORATE'S TASK
The main task of the Directorate is to contribute to maintaining sustainable economic growth and effective management of financial resources.
The Directorate:
7. participates in the budget planning of revenues and expenditure of State Fund Agriculture and of the Privatization Expenditure Fund within the Privatization Agency;
8. coordinates bills and drafts of secondary legislation, programs and strategies in the field of real sector;
9. represents the Ministry in the consideration and approval of projects related to the implementation of government programs in the field of coal mining, ore mining, uranium mining and remedying past environmental damages of privatized enterprises;
10. organizes the execution of the powers and functions of the Minister of Finance in his capacity of a representative of the state as an owner of interests and shares in the trade companies with state participation in the capital and the state enterprises;
11. maintains a database, analyzes the information and prepares forecasts of the key financial and economic indicators of the non-financial state and municipal enterprises;
12. carries out the monitoring, coordination and interaction with the European Commission in the State aid field by preparing positions, drafts and opinions on proposals for amending the legislation in the State aid field;
13. receives examines and assesses the notifications of State aid prepared by aid administrators for conformity with State aids legislation, transferring those to the European Commission, and prepares opinions regarding State aids falling within the scope of group exemption, as well as regarding de minimis aids;
14. assess the maximum intensity of regional aid and of the specific local scope of the areas in the Republic of Bulgaria which qualify for regional aid, and submit to the European Commission a notification of the regional aid map, after advance consultation with the Minister of Regional Development and Public Works;
15. compiles a draft of an annual report on State aids and transmits the said report to the European Commission and notifications of the subsidies granted under the World Trade Organisation Agreement on Subsidies and Countervailing Measures;
16. receives notifications and issues certificates for registration of tobacco products' sale price, and makes the entries in the Public register of the prices of tobacco products;
17. makes the entries in and keeps the registers of granted and withdrawn certificates for tobacco products manufacturing and of the administrative services provided in relation to the receipt of payments under the Act to settle Non-performing Loans contracted by 31 December 1990.
Public-Private Partnership, Concessions and Shareholdings Division - main functions:
1. coordinates the elaboration of bills and drafts of secondary legislation, methodologies, guidelines, instructions, financial models, financial and economic analyses and model contracts in the area of public-private partnership (PPP) in accordance with the best European and world practices and with a view to the effective and efficient spending of public funds;
2. provides methodical assistance to central and local authorities in the process of investment projects' development and structuring through PPP schemes;
3. where necessary, participates in the preparation of the state budget for the relevant year as regards the planning of funds for compensatory payments under PPP projects;
4. takes part in the project teams in regard to the development of PPP projects as well as in the processes of private partners' selection and implementation and control of PPP contracts in projects of national importance;
5. coordinates the analyses as to the expedience of PPP schemes' use for the implementation of investment projects of national importance as well as the financial and economic analyses of the developed PPP projects of national importance;
6. represents the Ministry of Finance in the European PPP Expertise Centre (ЕРЕС) and in the expert groups thereto, as well as in working groups on PPP at EU level, in the team of specialists on PPP to UNECE and in the expert groups thereto;
7. represents the Ministry in the activities related to granting of and exercising control over concessions where the Ministry's participation is regulated by a law;
8. coordinates Ministries' proposals for concessions' granting, prepares opinions on the financial and economic concession analyses, methodological guidelines and drafts of legislation, and takes part in interinstitutional committees on concessions;
9. prepares a bill of quantities for revenues from and expenditures for concession activities in general and by Ministry, and proposes it to the Minister of Finance for approval; administers annual concession revenues and expenditures;
10. organizes the execution of the powers and functions of the Minister of Finance in his capacity of a representative of the state as an owner of interests and shares in the trade companies with state participation in the capital and the state enterprises; analyzes the annual financial statements, the reports on the activity and the business plans of the sole owner companies and prepares minutes which are to be approved by the Minister; prepares drafts of powers of attorney for the Minister's representatives to the general meetings of the companies;
11. allocates the cash receipts under the transactions for privatization of state enterprises, participates in the analyses for the planning of the proceeds from privatization and the needed annual expenses; takes part in the preparation of the legislation, the annual privatization programs and the estimates of cash receipts;
12. maintains a database, analyzes the information and prepares forecasts of the key financial and economic indicators of the non-financial state and municipal enterprises;
13. takes part in the development of and coordinates the instructions on state financial support to mountain and small settlements and analyzes its economic and social effectiveness; ensures the timely payment of funds and prepares the needed information for the State aid provided to CCU under the "de minimis" rule;
14. prepares opinions, takes part in the elaboration and coordination of documents related the state policy on SMEs - investment environment and legislation, and Funds with state participation;
15. receives the notifications for registration of tobacco products' sale price, makes the entries and keeps up-to-date information in the Public register of the prices of domestic and imported tobacco products; issues certificates for registered sale prices;
16. keeps the register according to Article 6, paragraph 9 of the Compensation of Owners of Nationalized Properties Act and Article 5 of the Transactions in Compensatory Instruments Act, and on the grounds of Article 8, paragraph 6, item 2 of the Compensation of Owners of Nationalized Properties Act;
17. receives the payments with temporary certificates and/ or depository receipts of all due interest under legal persons' liabilities to the state under the Act to Settle Non-performing Loans contracted by 31 December 1990, and provides that information to NRA.
Public Funding of Real Sector and Agriculture Division - main functions:
1. participates in the preparation and drafting of the three-year budget forecast and the annual budget bill; prepares analyses and assessments for compliance of budget proposals of non-financial enterprises with the fiscal framework, the availability of resources and the government priorities and for their effectiveness and efficiency;
2. plans the annual government subsidies and compensations related to the provision of mandatory public services in the real sector and capital transfers to transport companies; assesses the efficiency and effectiveness of the policies relative to the funds provided according to the program budgeting principles and the EU regulations in respect of the activities supported;
3. participates in the elaboration of the triennial budget forecast and state annual budget bill in the light of planning and assessment of the effectiveness and efficiency of the budget resources administered by the Directorate;
4. prepares budget planning forecasts and monitors the expenditures under the European agricultural funds and the national programs financing agriculture - State Fund Agriculture; analyzes data and prepares guidelines for delivering monthly information on the Fund's budget cash performance;
5. coordinates and participates in the preparation of legislation in the field of tobacco production, Tobacco Fund financial policy, setting minimum purchase prices, tobacco producers premiums and other financial instruments;
6. analyzes, provides and controls capital transfers to National Railway Infrastructure Company, Bulgarian State Railways and Port Infrastructure;
7. participates in the drafting and coordination of legislation, programs and strategies in the field of real sector - the government policy in respect of mandatory public services in the field of transport; the country's energy policy; investments; financial support to transport, energy and other sectors, restructuring and privatization of state owned enterprises in the transport, energy, water services and other sectors;
8. analyzes and prepares opinions on proposals and issues related to price regulation and other financial aspects of activities in the electricity, central heating, natural gas, railway and urban transport, posts, telecommunications, water services, etc.;
9. prepares opinions on the legislation related to the Investment Encouragement Act;
10. provides information about the financial situation of state owned enterprises and companies subject to monitoring in pursuance of CMD No. 87/2008, beneficiaries of government guaranteed loans and their possibilities to service the loans received;
11. participates in the preparation of agreements for remedying past environmental damages of privatized enterprises, plans the budget resources required and exercises control over their spending;
12. prepares and coordinates draft legislation to regulate relations in the field of coal mining, ore mining and uranium mining;
13. represents the Ministry in the consideration and approval of projects related to the implementation of government programs in the field of coal mining, ore mining and uranium mining.
State Aid Division - main functions:
1. carries out the monitoring, coordination and interaction with the European Commission in the State aid field by preparing positions, drafts and opinions on proposals for amending the legislation in the State aid field;
