The State Legal Directorate has three divisions: Judicial Protection, State Property and Statutory Instruments. The Directorate performs the following functions provided for in Article 34 of the Ministry of Finance Structural Regulations:
- provide legal aid for the legally conforming exercise of the powers of the Minister;
- represent by counsel the Minister of Finance, the Ministry and the State before the judicial authorities according to Article 31 (1) of the Code of Civil Procedure;
- on assignment by the Council of Ministers organize and coordinate the representation of the State in international arbitration cases;
- analyze court case-law on the application of the statutory instruments in the sphere of finance and propose improvement of the said instruments or the proper application thereof;
- prepare legal opinions on drafts of laws and other statutory instruments, participate in inter-institutional task forces for preparation of drafts of statutory instruments, and organize a survey of the results of the application of statutory instruments in the field of finance;
- coordinate drafts of international agreements and agreements related to government and government guaranteed debt management;
- prepare legal opinions in connection with the exercise of the powers of the Minister for the acquisition, management and disposition of state property;
- support the Minister in performing enforced alienation of private real property for public needs procedures by coordination, analysis and methodological assistance;
- prepare legal opinions and participate in drafting Council of Ministers decisions for alienation of private real property intended for the building of national infrastructure projects;
- keep record of the immovable properties of the Bulgarian State abroad and render assistance to the settlement of the legal status of the said properties;
- prepare opinions on legal questions in connection with the activities and functions of the Ministry;
- propose the undertaking of measures on grounds of legal conformity for cessation of law violations and elimination of the causes and conditions that give rise to such violations.
